Momentum Wellness Terms and Conditions

Effective Date: July 1, 2025

Welcome to Momentum Wellness, LLC ("we," "our," or "us"). By purchasing or participating in any of our services, including digital programs or coaching, you agree to the following Terms and Conditions.

1. Service Overview

Momentum Wellness, LLC, formed in New Hampshire and Hawaii, provides remote fitness and wellness services. Our offerings currently include:

  • Digital training programs known as Momentum Blueprints:

    • Rebuild (90-day)

    • Launch (60-day)

    • Encore (90-day)

  • Waitlist-based 1:1 coaching (Momentum Signature)

Services are delivered through platforms including TrueCoach, Train Heroic, Calendly, Google Forms, and Squarespace. Communication is limited to app, Zoom, and email unless otherwise specified.

2. Client Eligibility

We accept clients 18 years and older. Clients under 18 must have parental consent, although we do not currently market or target individuals under 18.

3. Program Terms

Momentum Blueprints are standalone digital training programs. Each includes:

  • A fixed-duration progressive plan

  • Access via app (Train Heroic) with lifetime access

  • Lifetime access to downloadable PDFs

All Blueprint programs are non-refundable once delivered unless the conditions of our 30-Day Effort-Based Guarantee (outlined below) are met. No coaching is included unless explicitly stated.

Momentum Signature Coaching is a high-touch 1:1 coaching service offered by application or waitlist only. It includes:

  • Biweekly Zoom coaching calls (not to exceed 1 hour per session)

  • Custom programming delivered through TrueCoach

  • Messaging and video support via TrueCoach

  • Forum feedback and form reviews

Coaching includes a three-month minimum commitment. After three months, clients can:

  • Continue month-to-month at $399/month

  • Opt to pay the remaining nine months upfront at a discounted annual rate (currently $3,649)

All communication occurs through the TrueCoach platform. Programming and app access continue only while membership is active. Clients may save program content for personal use.

4. Payment Terms

All programs and services must be paid in full before access is granted. No prorated refunds will be issued for early cancellation or non-use. Payment plans, if offered, must be completed in full.

Momentum Wellness reserves the right to suspend or terminate access for failure to meet payment obligations. By selecting a payment plan, the client agrees to fulfill the total contract amount.

5. Cancellation and Refund Policy

Blueprints:

  • No cancellations or refunds once delivered unless the conditions of the 30-Day Effort-Based Guarantee are met.

  • Optional add-ons or upgrades purchased at checkout are also non-refundable.

30-Day Effort-Based Guarantee:

  • Clients who have purchased a Blueprint may request a refund within the first 30 days of delivery if they can demonstrate a good faith effort.

  • To qualify, clients must have completed at least 3 training weeks and submit a brief reflection on what did or didn’t work for them.

Coaching (Momentum Signature):

  • Requires a three-month minimum commitment.

  • After the three-month period, coaching does not auto-renew.

  • Clients must notify us prior to the end of their current term if they do not wish to continue.

  • Refunds are not available once a coaching cycle has started.

6. Communication Policy

Momentum Wellness does not provide live chat or phone support. Communication is limited to:

  • App messaging and video via TrueCoach

  • Email support

  • Biweekly Zoom coaching calls (not to exceed 1 hour per call)

7. Limitation of Liability

Momentum Wellness is not responsible for injuries, losses, or damages from participation in our programs. Clients must consult their healthcare provider before starting any new training plan.

8. Coaching Availability & Service Disruption

We commit to reasonable standards of availability and continuity in any coaching arrangements. In the case of illness, travel, or emergencies, communication delays will be addressed with appropriate notice and temporary accommodations (e.g., pauses or credits) when necessary.

9. Program Modifications for Injury or Illness

If a client is unable to continue due to injury or illness, Momentum Wellness may, at its discretion:

  • Provide temporary modifications

  • Offer a one-time programming pause (up to 30 days)

  • Issue credit toward future services (on a case-by-case basis)

Medical documentation may be required. Refunds will not be issued.

10. No Guarantee of Results

Results vary based on adherence, health status, and individual factors. Momentum Wellness does not guarantee specific outcomes.

11. Intellectual Property

All content, including videos, plans, PDFs, and written materials, is the intellectual property of Momentum Wellness, LLC. Programs are for personal, non-transferable use only. Sharing, duplication, or resale is prohibited.

12. Electronic Communication Consent

By providing your information, you agree to receive communications via email, app, and SMS (when applicable). You may opt out of marketing at any time. Coaching communication requires access to email and/or the app.

13. Governing Law

These Terms are governed by the laws of the State of New Hampshire. Disputes shall be handled through arbitration, virtual arbitration, or small claims court in New Hampshire.

14. Modifications to Terms

We reserve the right to update our offerings, features, or terms with reasonable notice.

16. No Medical Advice or Healthcare Services

Momentum Wellness coaching and digital programs are intended for general fitness, wellness, and educational purposes only. Although our coaches are licensed Doctors of Physical Therapy, we are not providing medical advice, diagnosis, or treatment as part of these services.

Participation in any program does not establish a patient-provider relationship. We do not store or transmit health records in a HIPAA-compliant manner, and our services are not intended to substitute for in-person physical therapy, rehabilitation, or medical consultation. Always consult your physician or licensed healthcare provider before beginning any exercise program.

By purchasing any program or submitting your information, you agree to these Terms and our Privacy Policy.
